By accessing and using the website at phishaver.com and the Phishaver platform (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. Use of the Service by your organization constitutes acceptance of these Terms on behalf of that organization.

2. Use of the Service

You may use our Service for lawful purposes only. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations;
  • Transmit any unsolicited or unauthorized advertising or promotional material;
  • Attempt to gain unauthorized access to any part of the Service or its systems;
  • Interfere with the proper working of the Service;
  • Engage in any conduct that restricts or inhibits anyone's use of the Service;
  • Use the Service to process data belonging to third parties without appropriate authorization;
  • Circumvent any security, rate limiting, or access control measures.

3. Account Registration and Security

To access the Phishaver platform, you must register for an account. You agree to provide accurate and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Platform Access and OAuth Authorization

Phishaver connects to your Microsoft 365 or Google Workspace environment via OAuth authorization. By authorizing the connection, you grant Phishaver read-only access to your email environment as described in your plan. You may revoke this authorization at any time from your Microsoft 365 admin center or Google Workspace admin console. Phishaver processes email data in accordance with our Privacy Policy and Security documentation.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Phishaver, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its underlying technology without our written permission.

6. Subscription Plans and Payment

Access to certain features of the Service requires a paid subscription. Subscription terms, pricing, and features are as described at phishaver.com/pricing.html. All fees are billed in advance. Phishaver, Inc. reserves the right to change subscription pricing with reasonable advance notice to existing customers.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Phishaver, Inc. does not warrant that:

  • The Service will be uninterrupted or error-free;
  • The detection results obtained through the Service will catch all phishing threats;
  • The quality of any information or analysis obtained through the Service will meet your specific security requirements.

Email threat detection involves inherent uncertainty. Phishaver's detection systems are designed to reduce risk — not to provide complete or guaranteed coverage against all phishing attacks.

8. Limitation of Liability

To the fullest extent permitted by law, Phishaver, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any damages arising from email threats that were not detected by the Service. Our total liability for any claims arising from your use of the Service shall not exceed the fees paid by you in the three months preceding the claim.

Our Service and website may contain links to third-party websites. These links are provided for your convenience only. Phishaver, Inc. has no control over the content of those websites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and sharing of information as described in the Privacy Policy.

11. Changes to Terms

Phishaver, Inc. reserves the right to modify these Terms at any time. We will notify you of material changes by email (to the address on your account) or by posting a notice within the Service. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of those changes.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Travis County, Texas.
